ECOWAS Court Awards N21 Million to Ghanaian Woman Married to Nigerian, Denied Passport Renewal and Entry into Ghana

The ECOWAS Court of Justice has awarded the equivalent of N21 million in compensation to a Ghanaian woman after ruling that her fundamental rights were violated when Ghanaian authorities denied her passport renewal and refused her entry into the country.

The woman, who is married to a Nigerian citizen, approached the regional court after alleging that the actions of the Ghanaian government left her stranded and effectively deprived her of her right to nationality, freedom of movement, and family life.

In its judgment, the ECOWAS Court held that the denial of passport renewal and refusal of entry constituted violations of her fundamental human rights as guaranteed under regional and international legal instruments. The court ordered the Government of Ghana to pay compensation amounting to approximately N21 million for the damages suffered.

The ruling reinforces the obligation of ECOWAS member states to respect the rights of their citizens, including the right to obtain travel documents and freely enter their country of nationality. It also underscores the importance of protecting family unity and preventing arbitrary administrative actions that infringe on basic human rights.

Legal experts have described the judgment as a significant victory for human rights within the ECOWAS region, emphasizing that governments must act in accordance with the rule of law and uphold the rights of their citizens regardless of personal circumstances.

The decision is expected to serve as an important precedent for future cases involving freedom of movement, citizenship rights, and the protection of fundamental human rights across West Africa.
